The Constitution establishes the principle of equal salary for equal work in the same conditions, efficiency and seniority. The Labour Code provides that equal pay corresponds to equal work done in the same post and conditions of efficiency and seniority inside the same enterprise. The Civil Service Act also provides that equal pay shall correspond to equal work done under equal conditions, efficacy and seniority.

2001, Labour Code, Sections 91 and 105 The Labour Code provides that the salary shall be determined freely, but that it cannot be established below the minimum wage. Through a structure of Paritary Commissions, minimum wages can be established for each intellectual, industrial, commercial, farming or agricultural activity, at a national scale or for specific parts of the country.
